A legacy in his blood...

Somewhere in your family tree, there may be a story of courage, a journey across the ocean, and the beginning of a new life in a distant country. Millions of people in Latin America, the United States, and other parts of the world are descended from Italians. If you are one of them, you may have inherited not only a surname or a family recipe, but also a fundamental right: Italian citizenship.

The Principle of 'Jure Sanguinis' (Right of Blood)

Unlike other countries, Italian law bases citizenship on 'jure sanguinis'. This means that if you have an Italian ancestor, citizenship is passed down from generation to generation, without limit. You are Italian from birth; you just need the government to officially recognize it.

How do I know if I'm eligible?

The general rule is simple: if your Italian ancestor (male) emigrated and had children before becoming naturalized in another country, the line of citizenship continues. However, there are some important peculiarities:

  • The '1948 Law' and Maternal Lineage: Before January 1, 1948, Italian women could not pass on citizenship to their children. If there is a woman in your line of descent who had her child before that date, the process cannot be carried out administratively (through consulates). But all is not lost! It is possible to claim this right through a judicial process in Italy, known as 'maternal judicial lineage'.

  • Naturalization of the Ancestor: It is crucial to verify if your Italian ancestor naturalized in your new country. If you did so before the birth of your child in that country, the line of transmission is broken.

Administrative vs. Judicial Routes: The Importance of Specialized Legal Advice

Navigating this process requires exhaustive genealogical research and a deep understanding of the law.

  • Document Search: The first step is to gather all birth, marriage, and death certificates from your Italian ancestor to you. At Cotarelli e Rodrigues, we specialize in searching for these documents, even in smaller Italian municipalities.

  • Case Analysis: We evaluate your line of descent to determine the correct route: administrative (simpler, but with long waits at consulates) or judicial (necessary for cases of maternal lineage pre-1948, and often faster).

  • Legal Representation in Italy: Our firm has the structure and partners to represent you directly in Italian courts for judicial cases, without you needing to travel. We manage the entire process, from preparing the legal action to obtaining the judgment that recognizes you as a citizen.
